Terms of Service
Last updated: 2026-08-22
These Terms govern your use of BiKhialesh ("we", "us", "the service"), a bilingual, anonymity-first social platform where posts are gated by active words. By creating an account or using the service you agree to these Terms. BiKhialesh is operated by Masoud Alali from the Netherlands. Contact: [email protected].
Eligibility and age
You must be at least 18 years old to use BiKhialesh. The service is not directed at children, and we do not knowingly collect data from anyone under 18. If we learn that an account belongs to someone under 18, we will close it and delete the associated account data. You are responsible for keeping your sign-in credentials secure.
How posting works (word gate)
Include or start with one of these words.
Your content and your responsibility
You are solely responsible for everything you post, including anonymous posts. You represent and warrant that your content does not infringe anyone's rights, is not unlawful, defamatory, hateful, harassing, or otherwise in breach of our Community Guidelines, and that you have the right to post it. Anonymity protects your identity from other users — it does not exempt you from responsibility for your content, and it is not a shield for illegal activity. You agree to indemnify and hold BiKhialesh harmless against any third-party claim, loss, or cost (including reasonable legal fees) arising from content you post or from your breach of these Terms, to the maximum extent permitted by applicable law. Nothing in this clause limits any liability that cannot be limited under mandatory consumer law.
Zero tolerance for objectionable content and abusive users
There is no tolerance for objectionable content or abusive users on BiKhialesh. By using the service you agree not to post content that is illegal, harassing, threatening, hateful, sexually exploitative, or otherwise objectionable, and not to abuse, harass, or threaten other users. When objectionable content is reported or detected, we review it and remove it where warranted, and we may suspend or permanently remove offending users at our sole discretion — subject to any statement of reasons and objection route the law requires. Note: the words used as posting prompts may include vulgar or taboo language by design; profanity in a prompt is not, by itself, objectionable content.
Intellectual property and your licence to us
You keep ownership of the content you create. By posting, you grant BiKhialesh a worldwide, non-exclusive, royalty-free, sub-licensable and transferable licence to host, store, copy, display, reformat, translate, distribute, and otherwise use your content for the purpose of operating, securing, moderating, improving, and promoting the service — including generating machine representations (such as embeddings) of your content for search, ranking, categorisation, and safety. This licence lasts as long as your content is on the service and for a reasonable period afterward to complete backups and removals. The BiKhialesh name, design, and software remain ours; these Terms grant you no rights in them.
Moderation, suspension, and termination
We may review, hide, remove, restrict, or refuse any content, and we may suspend, restrict, or terminate any account, at our discretion — for example where content breaches these Terms or our Community Guidelines, is unlawful, or threatens the safety or integrity of the service. Some content is reviewed by automated systems (see our Privacy Policy). We do not undertake to monitor every post and cannot guarantee that every violation is detected. Where we restrict or remove your content or your account, we will give you a clear statement of the reasons and information about how to object, as required by the EU Digital Services Act (Regulation (EU) 2022/2065), unless the law prevents us from doing so or the content can no longer be attributed to any account. You can contest a decision by writing to [email protected].
Ending your use
You may stop using BiKhialesh at any time and delete your account from your settings. When you request deletion, your account is closed immediately, content posted under your name leaves public view, and a 30-day restoration window begins in which you can get everything back by signing in again. When that window ends, deletion is finalized: your direct account identifiers and ordinary activity records are permanently erased or irreversibly replaced, and content you posted anonymously — which stays on the service throughout — is permanently detached from your account; if you have enabled the "deeper anonymity" option, anonymous posts may detach earlier (see our Privacy Policy). Residual copies may persist for a limited period in backups and logs before being erased on our normal cycle. We may keep minimal, pseudonymised records where needed for disputes, safety, legal holds, or the integrity of the service — see our Privacy Policy for details. The clauses that by their nature should survive — content licence wind-down, your responsibility and indemnity, disclaimers, and limitation of liability — survive termination.
"As is", no warranty, and limitation of liability
The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or uninterrupted or error-free operation. We do not guarantee any level of availability or uptime, and we may change, suspend, or discontinue features at any time. You use BiKhialesh at your own risk, including the inherent risks of an anonymous platform and of interacting with content and people you do not know. To the maximum extent permitted by applicable law, BiKhialesh will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill; and our total aggregate liability for any claim is limited to the amount you paid us, if any, in the 12 months before the claim. None of this excludes or limits liability that cannot be excluded or limited under mandatory law, including liability for death or personal injury caused by negligence, for fraud, or under your non-waivable rights as a consumer in the EU/EEA; for EU/EEA consumers, statutory rights are unaffected by these Terms.
Third-party services
BiKhialesh relies on third-party providers to operate — including Hetzner for hosting, OpenAI (and, where configured as fallbacks, Anthropic and Google's Gemini API) for automated content classification, and Google for sign-in and push notifications. We are not responsible for the acts, omissions, availability, or outputs of these providers beyond our own obligations to you, and your use of features that depend on them is subject to their performance. How we share data with these providers is described in our Privacy Policy.
Changes and governing law
We may update these Terms as the service evolves; we will post the updated version with a new "last updated" date and, for material changes, give reasonable notice. If you keep using the service after changes take effect, you accept the updated Terms. If any provision is found invalid or unenforceable, the rest stays in force. These Terms, together with our Community Guidelines, are the entire agreement between you and BiKhialesh about the service. Our Privacy Policy explains how we process personal data; it is a transparency notice provided as required by law, not part of this contract. These Terms are governed by Dutch law, and any dispute will be brought before the competent courts of Amsterdam, the Netherlands. Nothing here removes any mandatory protection or forum available to you as an EU/EEA consumer under the law of your country of residence.
